Michael A. Bowse

· Antitrust Litigation – Represented the inventor of a patented financial structure for a class of transportation-related, private-purpose municipal bonds in an antitrust action against multinational banks who dominate the underwriting of those bonds.

- Healthcare/Pharmaceuticals – Represents independent pharmacies in an action for unfair competition and breach of contract action against one of the country’s largest Pharmacy Benefit Managers based on allegedly illegal use of pharmacies’ proprietary data and patients’ private information to force patients to refill prescriptions via mail order pharmacies owned and controlled by the pharmacy benefit manager defendant.

· Mortgage Lending – As a member of the executive committee, on behalf of hundreds of thousands of homeowners, Mr. Bowse managed multiple federal and state consumer class actions that challenged the marketing and sale of an exotic class of home mortgage loans and alleged violations of the Truth in Lending Act, Federal Reserve System Regulation Z, and state consumer protection and common laws. Mr. Bowse helped to recover multiple settlements whose total value exceeded $2 billion.

· Apparel Copyright Infringement and Licensing Disputes – Defended a major designer and retailer of streetwear fashion in allegations of copyright infringement made by a contracted artist.

· Entertainment Breach of Contract Jury Verdict – As a member of two person trial team, obtained a multimillion-dollar jury verdict on a defendant’s cross complaint after securing a complete defense verdict. Mr. Bowse represented a notable music and documentary film producer who was sued by a high-profile rap musician and music label he featured in a film. At issue was the plaintiff rapper’s breach of contract, which prevented the release and distribution of the film.

· Independent Film and Television Alliance Arbitration– Defended an international film distributor in a dispute involving a multinational commercial bank alleging $75 million in payment obligations. The matter involved commercial/entertainment law, common law tort, unfair competition and various accounting issues under International Financial Reporting Standards (IFRS). Mr. Bowse’s representation in arbitration resulted in the bank receiving nothing on its claims of unpaid distribution fees.

· Venture Capital Investor vs. Venture Capital Investor – Represented a private equity investor, a former managing director in a LA-based venture capital firm, in his efforts to enforce his oral partnership agreement with his former firm. Mr. Bowse served as the attorney principally responsible for all pre-trial aspects of the litigation and on the trial team. The four-week jury trial resulted in a more than $100 million verdict in favor of his client, and eventually the case settled confidentially.

Litigation Across Key Industries - Within the entertainment industry, Mr. Bowse has led litigation involving film finance, film and television distribution, and film accounting. Additional industry sectors in his background include pharmaceuticals – generic and name brand drug litigation, prescription drug claims processing; technology – software licensing, computer hardware, and hardware design licensing; agriculture; manufacturing and telecommunications.

Financial litigation is a major practice area for Mr. Bowse. He has handled disputes involving municipal and corporate bond financing, private equity and venture capital, equity and debt investments, and financial services companies, including real estate lending and investments, money management and securities.

In addition, Mr. Bowse counsels clients in the fashion, textile and apparel industries. This includes enforcing and protecting intellectual property rights in lawsuits involving copyrights, licensing and royalties.
